Fun4u operiert auf internationaler Ebeneund zeichnet sich durch weit reichende Er -fahrungen in der Herstellung von Roll sport -artikeln aus. Mit den Eigenmarken “MYAREA” und “OEM” hat sich Fun4u als erfolg-reicher Skateboard-, Inline Skate- und Scooter-Anbieter am europäischen Markt etabliert.

Fun4u ist in drei operative Bereiche unter-teilt: Produkt ma na gement, Produktion undVertrieb. Alle Aktivitäten werden über denHauptsitz in Deutschland mit Büros inChina und Hong Kong gesteuert.

Unsere Strategie zielt darauf ab, wettbe-werbsfähig zu sein, ohne das Preissegmentzu verlassen. Fun4u ist bekannt für ihrenemotionalen Anspruch und ihre einzigarti-gen De signs. Fun4u is divided into three operation sec-tors: product management, manufactu-ring and distribution. All these activitiesare conducted through the Headquarter inGermany with offices in China and HongKong.

Our main strategy is to be competitive with - out being cheaper. Fun4u operates on anemotional level with unique designs. Ourmission is to place the product into theright channels. Fun4u is participating in allISPO Fair Activities, Germany, China andRussia. We are focalized on the EuropeanSport Market.

Der ‘Skatesurfer’

Das Einzigartige am Skatesurfer ist, dass erSkaten und Surfen verbindet wie noch keinSkateboard zuvor. Es entsteht ein völlig neuesFahrgefühl auf dem Skatesurfer, bedingt da-durch, dass dieses Board statt der üblichen 4Rollen, mit nur 3 Rollen ausgestattet ist. Dasverblüffende am Skatsurfer ist, dass das Boardganz leicht aus dem Stand heraus gestartetund beschleunigt werden kann und somit dieersten Lernerfolge schnell zu erkennen sind.Durch die Pumpbewegung mit dem vorderenBein gewinnt man Geschwindigkeit und kannsogar kleinere Steigungen anfahren, ohne wiebei einem konventionellen Skateboard denFuß vom Board nehmen zu müssen.

The ‘Skatesurfer ‘

The unique on “Skatesurfer” is, that it com-bines surfing and skateboarding like not askateboard before. The result is a complete-ly new riding experience, caused by the factthat this board is fitted with only three,instead of the usual four wheels. The mostamazing about “Skatsurfer” is the fact thatthe whole board can easily be acceleratedfrom a standing start and a fast success onlearning can easily be displayed. By using apumping motion with the front leg speedcan be gained easily and even small slopescan be mastered without the need oftaking a foot of the board, as on a conven-tional skateboard.

Cui ‘Skatesurfer ‘

L’unico “Skatesurfer” combina sia le caratte-ristiche di una tavola da surf che quelle diuno skateboard. Il risultato rappresenta unanuova esperienza di cavalcata, determinatadal fatto che questa tavola è composta da 3,anziché dalle tradizionali 4 ruote. La cosapiù stupefacente dello “Skatesurfer” è ilfatto che l’intera tavola può accelerare moltofacilmente partendo da una posizione stati-ca di partenza, ed è inoltre possibile impara-re molto velocemente. Mettendo la gambaposizionata sulla tavola, è possibile creare ilmovimento e guadagnare velocità graziealla spinta della gamba a terra, così come sifarebbe con un normale skateboard.

Allgemeine Geschäftsbedingungen der Fun4u Sportproduktion GmbH

§ 1 Geltungsbereich (1) Die nachfolgenden Geschäftsbedingungen gelten aus-schließlich; entgegenstehende oder von unseren AllgemeinenGeschäftsbedingungen abweichende Bedingungen des Kundenwerden nicht anerkannt, es sei den, wir hätten ausdrücklichschriftlich ihrer Geltung zugestimmt. Unsere AllgemeinenGeschäftsbedingungen gelten auch dann, wenn wir in Kennt -nis entgegenstehender oder abweichender Bedingungen desKunden die Lieferung an den Kunden vorbehaltlos ausführen.

(2) Alle Vereinbarungen und Nebenabreden, die zwischen unsund dem Kunden zwecks Ausführung des Vertrages getroffenwerden, sind nur wirksam, wenn sie schriftlich erfolgen. EinAbweichen von dem Schriftformerfordernis ist schriftlich nie-derzulegen.

(3) Sollten einzelne Bestimmungen der nachfolgenden Ge -schäftsbedingungen sich als unwirksam erweisen, ändert diesnichts an der Wirksamkeit der übrigen Regelungen. Unwirk -same Klauseln sind im Rahmen der Vertragsauslegung durchsolche zu ersetzen, die dem wirtschaftlichen Zweck der nichti-gen Klausel möglichst nahe kommen.

§ 2 Angebote und Vertragsschluss, Preise (1) Für den Inhalt des Vertrages ist die vom Kunden an dieFun4u Sportproduktion GmbH übermittelte Bestellung in derFassung der Auftragsbestätigung der Fun4u SportproduktionGmbH maßgeblich.

(2) Der Kunde ist an seine bei der Fun4u SportproduktionGmbH eingegangene Bestellung eine Woche gebunden.

(3) Alle Preise verstehen sich zzgl. der gesetzlichen Mehr wert -steuer (€).

§ 3 Lieferbedingungen, Gefahrübergang, Lieferverzug (1) Soweit keine abweichende Vereinbarung getroffen wurde,werden die Waren in Erfüllung des Vertrages von der Fun4uSportproduktion GmbH an dem Kunden an die von diesemangegebene Lieferanschrift, andernfalls an die Anschrift desKunden, mittels eines nach freiem Ermessen der Fun4u Sport -produktion GmbH bestimmten Versandart versendet. Für denFall des Verschuldens bei der Auswahl der Versandart haftet dieFun4u Sportproduktion GmbH nur bei Vorsatz und grober Fahr -lässigkeit.

(2) Bei Versendung der Ware geht die Gefahr des zufälligenUntergangs der Ware auf den Kunden über, wenn die Fun4uSportproduktion GmbH die Ware an die den Versand ausfüh-rende Person übergeben oder die Ware zum Zwecke des Ver -sandes das Lager der Fun4u Sportproduktion GmbH verlassenhat, gleich von welchem anderen Ort als dem Sitz der Fun4uSportproduktion GmbH die Versendung erfolgt.

(3) Nach Versendung der Auftragsbestätigung erfolgt der Ver -sand der Ware in der Regel innerhalb von drei Werktagen (Mon -tag bis Freitag) an den Kunden, wenn in der Auftrags bestä ti -gung nicht ein anderer Lieferzeitpunkt bestimmt ist.Überschrei tet die Fun4u Sportproduktion GmbH den in der Auf tragsbestätigung genannten voraussichtlichen Lieferterminum mehr als zwei Wochen, hat der Kunde der Fun4uSportproduk tion GmbH eine Frist zur Nacherfüllung von min-destens 10 Werktagen zu setzen. Erfolgt die Lieferung auchnicht innerhalb der Nachfrist, so ist der Kunde berechtigt, denRücktritt vom Vertrag zu erklären und/oder Schadenersatz zuverlangen, wenn nicht die Lieferung der Ware vor Erklärungdes Rücktritts oder des Schadenersatzbegehrens erfolgt ist.Beruht der Lie ferverzug auf der Nichtverfügbarkeit der bestell-ten Ware aus der Warenbezugsquelle oder stellt sich dieNichtverfügbarkeit der Ware nach Zustandekommen desKaufvertrages heraus, so ist auch die Fun4u SportproduktionGmbH berechtigt den Rück tritt vom Vertrag zu erklären. In die-sem Falle verpflichtet sich die Fun4u Sportproduktion GmbH,den Kunden unverzüglich über die Nichtverfügbarkeit zu infor-mieren und eventuelle Gegenleistungen des Kunden zu erstat-ten.

§ 4 Zahlungsbedingungen, Lieferung ins Ausland (1) Der Kaufpreis ist, wenn nichts anderes vereinbart wurde,spätestens bei Übergabe der Ware fällig und zahlbar. Die Fun4uSportproduktion GmbH ist berechtigt, die Ware per Nachnah meauszuliefern. Sind Teilleistungen vereinbart, ist der Kaufpreisentsprechend teilweise fällig.

(2) Bei Zahlung innerhalb von 10 Tagen ab Rechnungsdatumgewährt die Fun4u Sportproduktion GmbH einen Skonto i.H.v.2% des Netto-Preises.

(3) Lieferungen ins Ausland erfolgen erst nach Eingang desvollständigen Kaufpreises.

§ 5 Zurückbehaltungsrecht Der Kunde kann nur mit solchen Gegenansprüchen aufrechnen,die von der Fun4u Sportproduktion GmbH nicht bestritten wer-den oder rechtskräftig festgestellt sind. Ein Zurückbe haltungs -recht, das nicht auf demselben Vertragsverhältnis beruht, kannder Kunde nicht ausüben.

§ 6 Eigentumsvorbehalt (1) Die Fun4u Sportproduktion GmbH behält sich das Eigen -tum an der Ware bis zur vollständigen Bezahlung des Kauf -preises vor. Dies gilt, solange, wie nicht auch alle übrigen Warenaus derselben Bestellung durch den Kunden bezahlt sind.

(2) Die nachfolgenden Regelungen gelten nur im kaufmänni-schen Verkehr: Der Kunde darf den Liefergegenstand weder ver-pfänden noch zur Sicherung übereignen. Bei Pfändung sowieBeschlagnahme oder sonstigen Verfügungen durch Dritte hater die Fun4u Sportproduktion GmbH unverzüglich hiervon zubenachrichtigen.

(3) Der Kunde ist berechtigt, die Vorbehaltsware im ordentli-chen Geschäftsgang weiter zu veräußern unter der Voraus -setzung, dass die Forderungen aus dem Weiterverkauf wie folgtauf die Fun4u Sportproduktion GmbH übergehen: Der Kundetritt der Fun4u Sportproduktion GmbH bereits jetzt bis zurHöhe ihres Kaufpreisanspruches alle Forderungen mit sämtli-chen Nebenrechten ab, die ihm aus der Weiter veräu ße runggegen den Abnehmer oder gegen Dritte erwachsen, und zwargleichgültig, ob die Vorbehaltsware ohne oder nach Ver -arbeitung weiterverkauft wird. Zur Einziehung dieser Forderungist der Kunde auch nach der Abtretung ermächtigt. Die Befug -nis der Fun4u Sportproduktion GmbH, die Forderungen selbsteinzuziehen, bleibt hiervon unberührt; jedoch verpflichtet sichdie Fun4u Sportproduktion GmbH, die Forderungen nicht ein-zuziehen, solange der Kunde seinen Zahlungsverpflichtungenordnungsgemäß nachkommt. Die Fun4u SportproduktionGmbH kann verlangen, dass der Kunde ihr die abgetretenenFor derungen und deren Schuldner bekannt gibt, alle zum Ein -zug erforderlichen Angaben macht, die dazugehörigen Unter -lagen aushändigt und dem Schuldner die Abtretung mitteilt. Injedem Fall erlöschen die vorgenannten Sicherungen automa-tisch, sobald ihr Wert die zu sichernden Forderungen um mehrals 25 % übersteigt.

§ 7 Mängel, Rügepflicht, Gewährleistung und Verjährung (1) Der Kunde ist verpflichtet, die erhaltene Ware unverzüglichauf offensichtliche Mängel, Fehlmengen oder Falsch lie ferun -gen, insbesondere im Falle von Transportschäden durch dasTransportunternehmen, zu überprüfen und gegenüber derFun4u Sportproduktion GmbH zu rügen. Die Rügefrist beträgt 7Tage. Maßgeblich ist der Zugang einer schriftlichen (auch perTelefax) Rüge bei der Fun4u Sportproduktion GmbH. Gegen -über Kaufleuten gilt ergänzend § 377 HGB.

(2) Der Käufer ist verpflichtet, die beanstandete Ware derFun4u Sportproduktion GmbH in der Original- oder in gleich-wertiger Verpackung zur Überprüfung zurückzusenden. Beiberechtigter und fristgemäßer Mängelrüge wird die Fun4uSportproduktion GmbH die Versandkosten unverzüglich erstat-ten und die Mängel im Wege der Nacherfüllung gem. § 439BGB durch Nachlieferung oder Mängelbeseitigung beheben.Die Fun4u Sportproduktion GmbH ist nicht zur Nacherfüllungverpflichtet, wenn ohne ihre Zustimmung Eingriffe in oderÄnderungen an der Ware vorgenommen werden, es sei denn,der Kunde weist nach, dass der Mangel nicht durch diese Ein -

griffe und Änderungen verursacht wurde. Im Falle der Ver wei -gerung der Nacherfüllung, ihres Fehlschlagens oder ihrer Un -zumutbarkeit für den Kunden ist dieser zum Rücktritt oder zurMinderung berechtigt. Für Schadenersatz- und Aufwen dungs -ersatzansprüche des Käufers gilt § 8 dieser Geschäfts bedin -gungen.

(3) Die Verjährungsfrist für Mängelansprüche beträgt, wennder Kunde Verbraucher i.S.d. § 13 BGB ist 2 Jahre, wenn derKunde Unternehmer i.S.d. § 14 BGB ist 1 Jahr.

(4) Die Angabe von Merkmalen der von der Fun4u Sport pro -duktion GmbH angebotenen Waren auf der Website, in Kata -logen, Prospekten, Anzeigen, Mailings, Anschreiben, Preislisten,Abbildungen und Zeichnungen sind keine Beschaffenheits- undHaltbarkeitsgarantien, es sei, diese werden ausdrücklich als sol-che vereinbart.

§ 8 Haftung auf Schadenersatz und Aufwendungsersatz (1) Im Falle einer vorvertraglichen, vertraglichen oder außerver-traglichen Pflichtverletzung, auch bei einer mangelhaften Lie -ferung, unerlaubten Handlung und Produzentenhaftung, haf-tet die Fun4u Sportproduktion GmbH auf Schadenersatz undAufwendungsersatz – vorbehaltlich weiterer vertraglicher odergesetzlicher Haftungsvoraussetzungen – nur im Falle des Vor -satzes, der groben Fahrlässigkeit sowie im Falle der leicht fahr-lässigen Verletzung einer wesentlichen Vertragspflicht (Ver -trags pflicht, deren Verletzung die Erreichung des Vertrags -zweckes gefährdet). Jedoch ist die Haftung der Fun4u Sport -produktion GmbH – ausgenommen der Fall des Vorsatzes – aufden bei Vertragsabschluss voraussehbaren vertragstypischenSchaden begrenzt.

(2) Für Verzögerungsschäden haftet die Fun4u Sport produk tionGmbH bei leichter Fahrlässigkeit lediglich bis zur Höhe von 5 %des vereinbarten Kaufpreises. Dasselbe gilt bei einer leicht fahr-lässigen Verletzung wesentlicher Vertragsverpflichtungen durchdie Fun4u Sportproduktion GmbH.

(3) Die in den Absätzen 1 und 2 enthaltenen Haftungsaus -schlüsse und -beschränkungen gelten nicht im Fall der Über-nahme einer Garantie für die Beschaffenheit der Sache imSinne von § 444 BGB, im Falle des arglistigen Verschweigenseines Mangels, im Falle von Schäden der Verletzung des Lebens,des Körpers und der Gesundheit sowie im Falle einer zwingen-den Haftung nach dem Produkthaftungsgesetz.

(4) Sämtliche Schadenersatzansprüche gegen die Fun4uSportproduktion GmbH, gleich aus welchem Rechtsgrund, ver-jähren spätestens in einem Jahr nach Ablieferung der Ware anden Kunden, im Falle der deliktischen Haftung ab Kenntnis odergrob fahrlässiger Unkenntnis von den den Anspruch begrün-denden Umständen und der Person des Ersatzpflichtigen. DieRegelungen dieses Absatzes gelten nicht – und es gelten danndie gesetzlichen Bestimmungen – im Falle einer Haftung fürVorsatz und in den in Absatz 3 genannten Fällen. Etwaige kür-zere gesetzliche Verjährungsfristen haben Vorrang.

(5) Ist der Endabnehmer der Ware ein Verbraucher, gelten fürdie Verjährung eines etwaigen Rückgriffsanspruches des Käu -fers gegen die Fun4u Sportproduktion GmbH die gesetzlichenBestimmungen.

§ 9 Erfüllungsort, Gerichtsstand und Rechtswahl (1) Der Sitz der Fun4u Sportproduktion GmbH ist für beideTeile Erfüllungsort, wenn der Kunde Kaufmann ist oder es sichbei ihm um eine juristische Person des öffentlichen Rechtesoder ein öffentlich rechtliches Sondervermögen handelt odersich sein Wohnsitz außerhalb der Bundesrepublik Deutschlandbefindet. Für alle übrigen Vertragspartner gilt die gesetzlicheVereinbarung.

(2) Für die Vertragsbeziehungen gilt deutsches Recht unterAusschluss des UNKaufrechts für den internationalen Waren -verkehr (Übereinkommen der Vereinten Nationen über Verträgeüber den internationalen Warenkauf vom 11.04.1998 – CISG).
